Terms and Conditions may be amended, and changes will be reflected here. Should you not agree to the current terms or as they are amended, you are required to cancel your account immediately.
Our services are month to month, and you may cancel any time in compliance with the cancellation policy. Services and fees are on a month to month basis, and no refunds will be provided on recurring monthly charges beyond the money back guarantee period.

Should you for any reason dislike the features or services, please contact us within the first 5 days of your membership for a full refund. You may be asked to fill out a quality assessment survey to help us discover where we may need to improve our services. Refund will be issued after the survey is complete. If during the first 7 days you as the user violates any or all parts of the terms and conditions, no refund will be issued.
If you the user violates the terms and conditions in part or whole during the 5 day trial period, refund will not be issued and all applicable fines as outlined in the terms and conditions will be charged to your account.
You must always have a valid email address and phone number on file at all times. Should we need to contact you regarding your account, including but not limited to billing, upgrade or downgrade requests, cancellation confirmations, we need to be assured we can contact you in some form. Periodically we call new customers to verify that they have intitiated the payment in order to prevent fraud. This is to protect you as the buyer.
Your mailing address, which can be different from your biling address and may be a P.O. box, needs to be on file to comply with the CAN SPAM Act. According to the CAN SPAM Act, a valid postal mailing address must be included at the bottom of each outgoing email.
PRIVACY POLICY: User understands that a valid and regularly checked email address is required by UltraSponder.com for use of this service. UltraSponder.com will NOT give your email address or other private information to any 3rd party.
Your information will not be sold, rented, or traded for any reason. Any correspondence that is sent to you comes directly from UltraSponder.com or Ventrium Internet Business Services.
Cancellation: After the risk free period, no refunds will be issued. You must request the cancellation of your account at least 3 business days prior to your next scheduled recurring billing. If you do not submit your cancellation request at least 3 business days in advance, you will be charged for the upcoming month after which your account will be canceled.
Cancellation request must be submitted in writing with name on account, username, name on credit card, receipt/transaction number, and contact email address and phone number. You may be asked to fill out a quality assessment survey to help us discover where we may need to improve our services. Refund will be issued after the survey is complete. Should you violate our Terms of Service, Acceptable Use Policy, or abuse our services in any way including but not limited to spam, your account will be terminated without refund of any kind.
Any subscribers in the system will be forfeited. Please note that we do not bill you directly. You are billed by a 3rd party procesor such as Paypal, StormPay or INTgold. We do not have direct access to your payment account and only bill you per your monthly subscription in which you set up upon enrollment.
Billing: Membership is set up to provide convenient recurring billing each month which is automated by the payment option you select at time of enrollment. If your credit card is declined for recurring billing your account will be frozen.
You will receive notice by email regarding the declined payment and have the ability to provide a new credit card on file.
Your account will be deleted if your credit card is declined after 5 days of the initial notice.
Affiliates: Member that is eligible for affiliate program will get paid the following month after referral signs up. If referral cancels, no commission is issued. Commissions are paid out when earnings reach $25 USD or greater.
If referrer is found to be spamming to gain referrals for UltraSponder or uses UltraSponder to spam others, earnings will be forfeited. Commissions are determined by the price of the autoresponder service minus the cost of leads, if applicable, provided with the monthly package.
The cost of leads will be subtracted from the monthly membership fee, and commissions will be determined from that adjusted amount.
Spam: You agree not to send UCE or SPAM to any person using our services. You agree to immediately honor any and all removal requests that are personally sent to you by a recipient on your list(s). You agree to only use approved optin methods to acquire subscribers and to send mail to subscribers. No mention of UltraSponder, UltraSponder.com, Ventrium Internet Business Services, or the services purchased is allowed in the sending of your mail or other methods of advertising, marketing, or contact with your subscribers.
The only method approved to mention our services is to personally recommend our services to someone who has inquired upon and has a specific and legitimate need for services offered. Such an example would be referring our services to a newly enrolled Network Marketing home business member. UltraSponder.com and Verntrium Internet Business Services are entitled to determine if a referral or any mention of UltraSponder.com or the services provided by UltraSponder.com is acceptable or in violation of the Terms and Conditions.
If UltraSponder.com or Ventrium Internet Business Services receives any server issues, downtime, or any other consequences due to a spam complaint on your part, your account will be immediately terminate, and you are responsible for fees of $100 per hour until the problem is resolved to our satisfaction. If you receive a spam complaint, your account may be frozen during investigation of the complaint. This may take about 36-72 hours or longer if you cannot verify certain information promptly. You will be on First Level Warning Status.
If you receive 2 or more spam complaints, your account will be at Second Level Warning Status. You will be advised to delete leads from the entire list that was imported that has received a spam complaint. Your account will be frozen during the investigation of the complaint. If there is a third occurence of spam complaints, your account will be terminated without warning or refund. You will receive notice of the termination within 48 hours of termination. If your account receives 3 spam complaints within a 24 hour period, your account may be promptly terminated and warnings will not apply in this instant.
Using leads from an unapproved source and/or not providing the lead source on each lead in the system is grounds for immediate and non-refundable termination of account. Each lead in the system must include as part of imported information the lead source where lead was obtained. To exclude this information when importing, uploading or adding any recipient to any autoresponder account will result in termination of your account. Any leads in the system will be forfeited and unaccessable upon termination. Purchasing leads from UltraSponder.com or Ventrium Internet
Business services as well as outside option lead sources will not waive or cancel the spam policy. User account will still be investigated, frozen, liable for spam complaints and terminated if necessary, as determined by UltraSponder.com or parent company. This is to prevent abuse, to protect our service and to protect our other users as well. If you the user are found blatantly spamming, which includes but is not limited to: purchasing non-optin lists, purchasing or generating harvested emails, buying leads on CD, purchasing old lists,
or an act that UltraSponder determines as a blatant spam act, you are subject to fines up to $300 and are responsible for according to the terms as set forth here. This includes use of service from the initial sign up or enrollment time which includes the 7 day trial period. Spammers will be prosecuted to the fullest extent of the law. UltraSponder.com and Ventrium Internet Business Services reserve the right to determine what content of mailings, nature of product or services, or types of mailings are acceptable for the use of this system and service.
Should any product, service, or conduct of mailing practices fails to meet approval of UltraSponder.com and parent companies, user account will be terminated without refund. User is required to provide a valid "FROM" email address in the header, a subject heading related to the nature of the message contents, and to honor all removal requests directly received. Violation of these requirements would be considered a blatant spam act and would be subject fo fines as previously outlined.
Chargeback policy: By purchasing our services, you agree in full to the terms and conditions. You fully understand the no refund policy, and that it is a month to month service. You may cancel any time, and there is no refund of the month to month services. If you wish to cancel, you must do so with at least 3 business days between your request and your next billing date.
Should you attempt to pursue or file a chargeback, due to the terms and conditions set forth here, you will be responsible for fees from $40 and up to an ADDITIONAL $10 per day on top of the minimal fee for your attempted chargeback. This is to attempt to collect fees that are incurred by Ventrium Internet Business Services or UltraSponder.com as a result of the chargeback.
The daily charge is implemented until you provide the necessary paperwork to Ventrium Internet Business Services to drop the chargeback claim. This policy is in place and enforced to prevent unscrupulous customers for using a service and then attempting to get a chargeback which ultimately results in free service. Even if this is not your particular reason for a chargeback,
the policy is still enforced and in effect on any and all chargebacks.
Leads: All leads imported into our system must be 100% optin and contain at leads the following information: first name, last name, email address, IP address, Time/Date Stamp, Lead Source Provider. We strongly urge that the first autoresponder account be used for 1 single email to generate a personal optin status, using a customized email to request that the lead/subscriber confirm that he or she agrees to receive additional emails from you. To get them into the second email autoresponder which would include your follow up emails, you can use a generated sign up form available in the member area to gain their approval and transfer the lead to the follow up system, or instruct the recipient to email you at your autoresponder email address to add his or her name and email address to the second list. This is recommended to prevent UltraSponder.com from implementing a generic optin confirmation email that is sent to each newly imported subscriber/lead/prospect. It is our belief that if you send a brief customized email containing a reminder of what the subscriber/lead/prospect requested information about is much better at yielding positive results than a very generic email confirmation. To avoid this action, make sure that your first account begins with an email asking for permission to email your subscriber. If it is an existing list/ezine that you are transferring, send an email informing each subscriber that it is the same list moderated by the same person or company but simply under a new system. According to our terms of service, you are not allowed to mention UltraSponder, UltraSponder.com, or Ventrium Internet Business Services in any correspondence to reciptients on your lists or in our system.
Use of account: Users and members are not permitted to share, distribute or email any information that is considered vulgar, harrassing, violent, hate crime related, illegal or otherwised deemed a breech of acceptable use. Such unacceptable materials include but are not limited to: pornography, adult websites, spam, racist comments or material, casino or gambling information comments or material, offensive material or comments, warez or any illegal material.
Each account including multiple account autoresponders are authorized only for one (1) user. It is a violation of the terms and services to allow the use of any autoresponder within your account by any other user other than the person who is signed up as the sole user and payee. Sharing, renting, or distributing any autoresponder within your account will result in immediate termination of your account without refund and with fees for the use of the account based on the number of unauthorized users. Fees will be $30 per unauthorized user per month of use.
Profit or Loss Claim: UltraSponder.com and Ventrium Internet Business Services claim no expressed or implied profit amount by use of this system. Nobody can claim any type of profit. Your success in the business of your choice depends largely upon the product or services offered, personal choice by future or existing customers, effectiveness of marketing materials as well as other factors. You agree to use this service "as is" with no claim of profitabillity or loss.
You agree to idemnify and hold harmless UltraSponder.com and Ventrium Internet Business Services and any affiliate, representative, member, or agent from any claims resulting from use of service. You agree that use of this service is at your sole risk. UltraSponder.com, Ventrium Internet Business Services, nor its providers, agents, affiliates, licensors or employes shall be liable for any damages suffered by you or any other individual or, party or company as a result of using or misusing this service. UltraSponder.com and Ventrium Internet Business Services make no warranties of any kind for the service provided, either expressed or implied. UltraSponder.com nor Ventrium Internet Business Services will not be held liable for any damages suffered to user or member including but not limited to: loss of data as a result from delays, nondeliveries of email, misdeliveries of email, service outages caused by technical or other issues whether by UltraSponder.com or other actions of server downtime or other reasons not listed. UltraSponder.com nor parent or affiliate companies will be held liable for any damages suffered to user or member by use of UltraSponder.com autoresponder system. UltraSponder.com or affiliate or parent companies do not warrant that the service will be error free or uninterruped. The service is distributed on an "as is" basis without warranties of any kind, either expressed or implied. This includes but does not have limits to warranties of merchantability or fitness for purpose.
These terms and conditions as set forth here supersede all previous written, verbal, or implied provisions or agreements. Use of these services provided by UltraSponder.com and Ventrium Internet Business Services constitutes acceptance of these terms and conditions. UltraSponder.com reserves the right to make changes and ammendments to these terms and conditions. Users may either by notified or changes by email OR by posting ammendments on this page.
User agrees that UltraSponder.com has the right to freeze or terminate service of user account(s) at any time. Reasons for freezing or termination of account may be due to but not limited to: non-payment, illegal activities, spam complaints, or violation of the terms and conditions.
